Terms and Conditions

1. Introduction

Welcome to the Indico Digital Food Ecosystem Platform.

Access to the TelkomselDFE Platform may be gained via www.dfe.farm and an application that will be available at your Android OS and iOS in your smartphones. The terms & conditions (“Terms of Use”) set out below govern the use of TelkomselDFE Platform, for the use via www.dfe.farm, TelkomselDFE application, or other official links of TelkomselDFE.

By agreeing to these Terms and Conditions, registering on and/or using the TelkomselDFE Platform, a User is considered to be truly competent and able to bind himself/herself to these Terms and Conditions and is deemed to have read, understood, comprehended and agreed to all contents in these Terms & Conditions. These Terms and Conditions are a form of agreement and/or arrangement that is valid and binding between the User and Indico which contains the rights and obligations of the User when using and/or accessing the TelkomselDFE Platform. Therefore, the User is advised to read these Terms and Conditions carefully before giving his/her consent. If the User does not agree to one part, some, or all of the contents of these Terms & Conditions, then the User is not allowed to use the services available on the TelkomselDFE Platform.

2. Update Terms and Conditions

These Terms of Use may be amended and/or updated from time to time. Indico recommends that you read carefully and check these Terms and Conditions pages from time to time for any changes. By continuing to access and use this Service after notification of updates from Indico, then you are deemed to agree to the changes to these Terms of Use (if any).

3. Definition

a. PT Telkomsel Ekosistem Digital (“Indico”) is a Limited Liability Company whose one of its business units conducts service business activities in TelkomselDFE that is available at www.dfe.farm and TelkomselDFE application.

b. TelkomselDFE Platform is a TelkomselDFE website on www.dfe.farm and TelkomselDFE application that is available on Android OS and iOS platforms which provides an agri-food technology solution by combining Internet-of-Things (“IoT”) sensors, data processing analysis, and other supporting tools to meet the user’s needs related to farming and agriculture.

c. Terms & Conditions is an agreement between the User and Indico which contains a set of rules governing the rights, obligations, responsibilities of the User and Indico, as well as the procedures for using the system of TelkomselDFE Platform.

d. Content as referred to in the Terms and Conditions below takes the form of all materials contained in the TelkomselDFE either Images, Articles, Videos, Indico Products, Indico Partners’ Products, Comments, or User’s Products.

e. User is the party who uses the Platform and/or orders a TelkomselDFE Solution.

f. TelkomselDFE Solution is a solution in the form of food technology services by combining IoT and data analysis to achieve a better and sustainable food ecosystem provided by Indico and/or partners who work closely with Indico.

4. Account, Password and Security

a. The User hereby declares that the User is a person who is capable and has the capacity to bind himself/herself in a valid agreement under the law.

b. Indico does not charge a fee to the User for registration on the TelkomselDFE Platform.

c. The User who will use the TelkomselDFE Solution is required to register on the TelkomselDFE Platform, and make payment transactions according to the options and conditions available on the TelkomselDFE Platform.

d. Indico without prior notification to the User, has the authority to take necessary actions for any alleged violation of the Terms & Conditions and/or applicable law. Actions that can be taken include but are not limited to deleting a content, suspending an account, deleting the user’s account and/or other actions in accordance with the applicable laws and regulations.

e. Indico has the authority to close the User’s account, either temporarily or permanently if it is found that there is a violation of these Terms and Conditions and the applicable laws and regulations.

f. The User is prohibited from creating and/or using devices, software, features and/or other tools that aim to manipulate the TelkomselDFE system, including but not limited to: (i) manipulating the user’s data; (ii) spamming activities; (iii) manipulating the content engagement and (vi) other activities that can reasonably be deemed as actions of manipulating the system.

g. The User is fully responsible for maintaining the confidentiality of the account and password for all activities carried out in the User’s account, including but not limited to any risks and/or losses that arise as a result of the misuse of the account by third parties. Indico has the right to assume that the User’s access to the TelkomselDFE Platform, including the use of the User’s account and password, is an access made by the User legally. The User hereby releases Indico from all claims that may arise in any form and from any party.

h. Indico will not ask for username, password, verification SMS, verification email, or OTP code belonging to the User’s account for any reason. Therefore, Indico urges the User not to provide such data or other important data to parties on behalf of Indico, the TelkomselDFE Platform or other parties whose security cannot be guaranteed, in the event that logging in is not done directly by the User in person.

i. The User agrees to inform Indico if the User finds any misuse or use of the User’s account and/or password without permission, and ensures that information is submitted to email support@dfe.farm at the end of each session and log out.

j. The User hereby declares that Indico is not responsible for any losses or problems arising from misuse of the User’s account caused by the User’s negligence, including but not limited to lending or giving the account access to other parties, accessing a link or links provided by other parties, providing or showing a password or an email to other parties, as well as other negligences of the User which result in losses or problems on the User’s account.

5. Use of OTP

a. Registration of the User on the TelkomselDFE Application uses the OTP mechanism for the verification process of the user.

b. The OTP sent is confidential. The User is fully responsible for maintaining the confidentiality of his/her OTP; therefore, the User is not allowed to:

  1. Inform of the OTP to other people;
  2. Store the OTP in the User’s communication device or other storage facilities that allow other parties to know.

c. Indico has the right to consider that an access to an Application that uses the User’s OTP is valid to the Application which is made by the User and without the need to be proven.

d. If the User feels that he/she did not make a request to register a TelkomselDFE account, please ignore the email and/or SMS containing the OTP and please keep the OTP given to the User confidential.

e. The User hereby declares that Indico is not responsible for any losses or problems arising from any misuse of the User’s account caused by the User’s negligence, including but not limited to lending or providing access to an email and the OTP to other parties, giving or showing the OTP or an email to other parties, or other negligences of the User which result in losses or problems on the User’s account.

6. Content Creation

a. In using any features and/or services of the TelkomselDFE Platform, the User is prohibited from uploading or using any words, comments, images, or contents that contain elements of ethnicity, religion, race, and inter-group (SARA), violation of decency, pornography, discrimination, gambling, insults, demeans or oppression of other people, being vulgar, threats, extortion, defamation, violation of intellectual property rights or contrary to the applicable laws and regulations, and other matters that may be deemed incompliant with the social values and norms or based on the policies determined by Indico. Indico has the right to take necessary actions for any violations of this provision, including but not limited to deleting a content, moderating a content, blocking an account, and other matters that are deemed necessary under the laws and regulations.

b. The User is prohibited from using photos/images that have a watermark indicating the ownership rights of others. If the user is going to use other people’s content, he/she must include the source and/or consent of the content owner.

c. The User hereby understands and agrees that the misuse of the photos/images uploaded by the User is the User’s personal responsibility. Indico is not responsible for any infringements committed by the User of other people’s intellectual property rights used on the TelkomselDFE Platform.

d. When uploading a content to the TelkomselDFE Website, the User grants Indico non-exclusive, worldwide, perpetual, irrevocable, royalty-free, sublicensed (through several levels) rights, the rights to exercise any and all copyright, publicity, trademarks, database rights and intellectual property rights that the User has in the content, in any known media now or in the future. Furthermore, to be fully authorized under the applicable laws and regulations, the User waives moral rights and is willing not to claim these rights against Indico.

e. Any content or materials that will be displayed or published on the TelkomselDFE Website will be subject to these Terms and Conditions, laws and regulations, and applicable content ethics.

f. Indico has the right to take down any content or materials contained in TelkomselDFE which is considered to violate these Terms and Conditions, applicable laws and regulations, and applicable content ethics.

7. TelkomselDFE Solution

a. Indico provides a TelkomselDFE Solution feature on the TelkomselDFE Platform. The available services can be activated by the User at a cost.

b. Information and Description of the TelkomselDFE Solution, along with the specific terms and conditions for the solution are separately governed on the TelkomselDFE Platform.

c. Indico is not responsible for any losses or problems that arise from the solution ordered by the User from the TelkomselDFE Solution Product.

d. Indico has the authority to close the User’s account, either temporarily or permanently if it is found that there is a violation of the terms and conditions of the TelkomselDFE Platform.

e. For any payment using prepaid deposit or postpaid phone bill, in the event of an error and/or discrepancy in the payment using the Indico Billing Method, the User may directly contact the TelkomselDFE contact center at support@dfe.farm or other media listed on the www.TelkomselDFE website. com. For payments other than the Indico Billing Method, you may directly contact the payment partner.

8. Transactions Using the TelkomselDFE Solution

a. The User is required to transact through transaction procedures that have been determined on the TelkomselDFE Platform. The User makes a payment using the payment method previously selected by the User.

b. When ordering the TelkomselDFE Solution, the User agrees that:

  1. The User is responsible for reading, understanding, agreeing to the information/description of the entire Solution before making an offer or commitment to use the Solution.
  2. The User is aware and acknowledges that there may be discrepancies between the illustration photos as shown on the TelkomselDFE and the actual appearance when the Solution is implemented, which depends on the computer screen or the User’s device.
  3. The User enters into a legally binding contract.

c. The User understands and agrees that the availability of TelkomselDFE Solution may change at any time, so that in the event that the service is not available, Indico may refuse the order and the payment for the relevant Solution is returned to the User.

d. The user fully understands and agrees that all transactions carried out other than through the official account of the TelkomselDFE Platform and/or the payment media provided on the TelkomselDFE Platform and/or without Indico’s knowledge (through private facilities/networks, messaging, special transaction arrangements outside the TelkomselDFE or other methods of payment) is the personal responsibility of the User. Indico is neither responsible nor held accountable for any transaction activities outside the official account of the TelkomselDFE Platform and/or payment media provided on the TelkomselDFE Platform.

e. Payment for the TelkomselDFE Solution by the User must be made immediately after the User confirms the purchase. If within the specified period the payment or payment confirmation has not been made by the User, Indico has the authority to cancel the transaction. The User has no right to file a claim or demand for the cancellation of the transaction.

f. The User agrees not to notify or submit proof of payment and/or payment data to parties other than Indico. In the event of a loss due to notification or submission of the proof of payment and/or payment data by the User to another party, it will be the responsibility of the User.

g. The User is required to confirm receipt of the TelkomselDFE Solution after receiving the service, product or services ordered. Indico provides a maximum period of 3 (three) days after delivery with the status of “waiting for payment” on the TelkomselDFE system, for the User to confirm receipt of service, product or services. If within that period there is no confirmation or claim from the User, the User is deemed to have agreed to the automatic confirmation of product receipt by the TelkomselDFE system.

h. The User understands and agrees that any claim that is filed after the confirmation or automatic confirmation of receipt of the service, product or services is the personal responsibility of the User.

i. The User understands and agrees that any product delivery problems caused by late payments are the responsibility of the User.

j. The User understands and agrees that delays in the payment process and additional fees due to a discrepancy between the bank used by the User and the official TelkomselDFE bank account is the personal responsibility of the User.

k. Refunds from Indico to the User can only be made if the following certain circumstances occur:

  1. the User overpays the price in the service catalog;
  2. TelkomselDFE does not accept an order due to stock availability, or other reasons; and/or
  3. TelkomselDFE has agreed to send an order, but after the specified period it turns out that it cannot deliver the service until the specified period.

l. In the event of a refund process, it will follow the payment method selected by the User:

  1. In the event that the User uses electronic money (LinkAja, GoPay, DANA, and ShopeePay), the refund will be sent to the User’s bank or GoPay account within a maximum of H+7 working days;
  2. If the User uses a credit card, the bill for the transaction will be canceled and the transaction funds will be returned to the User’s bank account within a maximum of H+7 working days.

n. The refund process from Indico to the User will only be carried out by the TelkomselDFE Platform administration team. Indico is not responsible for any dishonest acts, criminal acts, fraud, negligence, serious violations of laws and regulations, or malicious acts committed by irresponsible parties on behalf of the TelkomselDFE administration team or Indico through the TelkomselDFE Platform.

9. Price

a. The price for the services listed on the TelkomselDFE Platform is the price determined by Indico.

b. The User understands and agrees that an error in price details and other information caused by the TelkomselDFE Platform page not being updated due to the device/browser/ISP used by the User is the responsibility of the User.

c. By placing an order through the TelkomselDFE Platform, the User agrees to pay the total fee to be paid as stated on the payment page, which consists of the price of goods, delivery cost, and other costs that may arise and are explicitly described on the payment page. The User agrees to make payment through the payment method that has been previously selected by the User.

d. The TelkomselDFE platform currently only serves sale and purchase transactions in Rupiah.

10. Service Fee

Service Fee is a fee charged to the User for the purpose of system maintenance and service improvement in transactions through the TelkomselDFE platform with the following terms and conditions: a. The User will be charged a Service Fee for every transaction on the TelkomselDFE platform that uses the following payment methods but is not limited to:

9. Virtual Account Mandiri
10. Virtual Account Mega
11. Finpay Money
12. Kredivo
13. OVO
14. Dana
15. GOPAY
16. QRIS

Remarks

  1. Business Days are Monday to Friday except for national holidays and collective leave determined by the Government and/or non-bank days stipulated by Bank Indonesia or the Financial Services Authority.

  2. Cut-Off Time is a time when all Customer Transactions carried out on that day are recorded by the Parties as the basis for payment, in this case at 23:59:59 Western Indonesia Time (WIB).

  3. Payment Gateway transfers Funds (Settlement) to Indico account at least at 14.00 Western Indonesia Time (WIB) on D+1 working day.

b. The User understands and agrees that with the issuance of Law Number 10 of 2020 on Stamp Duty as of 1 January 2021, if the total Service Fee charged in one transaction is more than IDR 5,000,000 (five million Rupiah), the User will be charged IDR 10,000 (ten thousand Rupiah) Stamp Duty, which will be billed at the time the payment is made.

c. If there are transaction problems that cause the transaction to be canceled and a refund process occurs, the refund mechanism and transfer fees that appear will follow the following scheme:

  1. In the event that the cancellation of the transaction is initiated by the Seller, some of which may occur due to no order confirmation by the Seller, delivery problems caused by the Seller, or the Seller cancels the order, the refund transfer fee will be charged to the Seller;
  2. In the event that the cancellation of the transaction is initiated by the Buyer, which may occur because the Buyer changes his mind or cancels the order, the refund transfer fee will be charged to the Buyer;
  3. In the event that the transaction cancellation is caused by other factors such as network constraints causing the Buyer to overpay, the refund transfer fee will be charged to the FEED Platform.

d. A GoPay account can be selected as the destination account if the price of the goods is below IDR 2,000,000 (two million Rupiah).

e. If there are problems with credit card transactions and a refund process occurs, the funds to be returned are equal to the price of the goods excluding administration fees and will be fully returned to the User to the User’s bank account. As for the stamp duty fee that has been paid by the User, it is non-refundable.

f. The User understands and agrees to release Indico from all forms of responsibility if there is a loss suffered by the User for any transactions made on the TelkomselDFE Platform.

11. Promotion

a. Indico may at any time hold promotional activities (hereinafter referred to as “Promo”) with the Terms and Conditions that may differ for each Promo activity. The User is encouraged to read carefully the Terms and Conditions of the Promo.

b. Indico has the right, without prior notification, to take necessary actions including but not limited to withdrawing subsidies or cashback, canceling TelkomselDFE Point benefits, revoking the Promo, canceling transactions, withholding funds, reducing reputation, closing an account, and other things if it found any manipulation, violation or use of the Promo for the User’s personal gain, as well as indications of fraud or violation of the TelkomselDFE Terms and Conditions and the laws and regulations applicable in the territory of the Republic of Indonesia.

c. The User may only use 1 (one) TelkomselDFE account to participate in every TelkomselDFE promo. If it is found that the creation of more than 1 (one) account by the same 1 (one) User and/or the same handphone number and/or the same email address and/or the same customer ID and/or the same payment identity and/or the same history transaction, the User is not entitled to benefit from the TelkomselDFE promo and Indico has the right to take other actions that are deemed necessary.

12. Withdrawal of Service

Indico has the right to withdraw/reclaim the Service from the User either temporarily or completely in the event of a technical error and/or misuse of the Service with prior notification and the User agrees to release Indico from all legal claims and responsibilities with due regard to the rights of the User.

a. Indico or a third party in collaboration with Indico may provide a Content that will be uploaded on the TelkomselDFE Platform. Third Party Contents may be in the form of writing, photos, images, sounds, videos containing information and data created by a Third Party so that the Third Party is fully responsible for all consents required for these activities.

b. Indico may provide certain links that refer or direct the User to a page from a Third Party site, including links available on certain product search results pages.

14. Marketing and Promotional Materials

Indico and Third Party partners in collaboration with Indico may send the User direct marketing, advertisements, and promotional communications through push-notification applications, messages through TelkomselDFE, telephone calls, short message services, emails, rich media formats, and other technology media that developed from from time to time (“Marketing Media”). The User can choose not to receive such marketing communications at any time by typing/clicking “unsubscribe” in the relevant Marketing Media, or contacting Indico via the contact details provided. Please note that if the User chooses not to receive marketing communications, Indico can still send the User non-promotional messages, such as receipts, notifications and SMS confirmation of TelkomselDFE.

15. Intellectual Property Rights

a. Indico has various brands, logos, as well as websites and applications which are all protected by the applicable laws and regulations in Indonesia, such as but not limited to the Copyright Law and Trademark Law. The User acknowledges and agrees that Indico’s Intellectual Property Rights (IPR) that are used or displayed on the TelkomselDFE Platform, both the website and the application, or any IPR belonging to third parties contained in this service, may not be copied, used, applied and implemented in its entirety or in part, without prior written consent from Indico and/or other parties who own the IPR contained in the TelkomselDFE Platform. Indico has the right to claim the use of IPR illegally under the applicable laws and regulations.

b. All forms of images, logos, videos or other forms contained in the TelkomselDFE Platform whose intellectual property rights are owned by third parties are assets of the third parties.

c. The User guarantees that he/she does not violate intellectual property rights in uploading the User’s content to the TelkomselDFE Platform. Any User hereby is personally responsible for the violation of intellectual property rights in uploading a content on the TelkomselDFE Platform. Indico is not responsible for violations committed by the User of other people’s intellectual property rights used on the TelkomselDFE Platform.

16. Complaints of Obstacles or Problems

The User may contact the TelkomselDFE Platform complaint handling center at any time on support@dfe.farm. The TelkomselDFE Platform complaint handling team will strive to respond to the User’s complaints within 5 x 24 hours after receiving the complaint.

17. Limitation of Liability

a. Indico does not guarantee that (i) the TelkomselDFE Platform will always meet the User’s needs or will always be accessible; (ii) the TelkomselDFE Platform will be uninterrupted, timely, secure, and free from any error; (iii) The results obtained will always be accurate or reliable; (iv) the quality of each product, service, information or other materials purchased or obtained through the TelkomselDFE Platform will always meet the User’s expectations.

b. Indico is not responsible for any dishonest acts, criminal acts, fraud, negligence, serious violations of laws and regulations, or malicious acts committed by irresponsible parties through the TelkomselDFE Platform.

c. Indico is not responsible in the event of any loss to the User when using the TelkomselDFE Platform due to force majeure reasons as described in these Terms of Use.

d. The User is responsible for and bears all risks for the content, language and applications that are consciously included so that they are available and displayed on the TelkomselDFE Platform. In the event that there is a personal violation by the User such as but not limited to violation of intellectual property rights, system manipulation, account abuse or other negligences of the User, he/she is personally responsible for the violation and releases Indico from any claims arising from any third parties.

e. In order to provide more varied payment methods, Indico cooperates with various parties to make it easier for the User to choose a payment method that suits his/her needs. Therefore, in the event of a discrepancy and/or error in the payment method provided by the payment partner, both in terms of the system and its use, the User hereby releases Indico from the responsibility to provide compensation for losses that arise due to the payment partner’s error.

f. The User acknowledges, understands, and agrees that Indico is not responsible for any contents and/or links contained in the Service. The User is responsible for the risks when accessing and using the contents and/or links belonging to such Third Parties. In addition, it is recommended that the User read and understand the contents of the terms and conditions that apply to the contents/links belonging to these Third Parties.

g. To the extent permitted by the applicable laws and regulations, Indico (including the Parent Company, its directors, and employees) is not responsible, and the User agrees not to hold Indico responsible for any damage or loss (including but not limited to loss of money, reputation, gain, or other intangible loss) resulting directly or indirectly from:

  1. use or inability of the User in utilizing the TelkomselDFE platform
  2. Price, Delivery, or other instructions available on the TelkomselDFE platform
  3. Delay or interruption in the TelkomselDFE platform
  4. Negligence and losses incurred by the User
  5. Quality of Goods
  6. Delivery of Goods
  7. IPR Infringement
  8. Disputes among Users
  9. Defamation of others
  10. Misuse of Goods that have been purchased by the User.
  11. Losses due to unauthorized payments to parties other than to the TelkomselDFE Account in any way on behalf of Indico or negligence in writing accounts and/or other information and/or negligence on the part of the bank.
  12. Viruses or other malicious software (bots, scripts, automation tools, hacking tools) obtained by accessing, or connecting to the TelkomselDFE Platform
  13. Glitches, bugs, errors, or inaccuracies in the TelkomselDFE Platform
  14. Damage to the User’s hardware from using any TelkomselDFE Platform
  15. Contents, actions or inactions of third parties
  16. Enforcement actions taken with respect to the User’s account.
  17. Hacking action taken by a third party to the User’s account.

18. Waiver

If the User has a dispute with one or more other Users, he/she releases Indico (including the Parent Company, its directors and employees) from claims and demands for any damages and losses (actual and implied) of any kind and nature, known and unknown, arising out of or in any way connected with the dispute. Thus, the User intentionally waives all legal protections (contained in the law or other laws and regulations) which will limit the scope of the provisions of this waiver.

19. Indemnity

The User will indemnify Indico and save Indico (including the Parent Company, its directors, and employees) harmless against any and all claims or demands, including all legal fees, initiated by third parties arising in the event that the User violates these Terms and Conditions, the use of the TelkomselDFE Platform inappropriately and/or the User’s violation of the laws or the third parties’ rights.

20. Service Update

Indico has the right to update the Service at any time, with considerations such as but not limited to: (i) it is determined by the competent authority; (ii) it is not in accordance with the latest developments in the times and technology; (iii) it is no longer used and will be transferred to a similar Service; and (iv) other considerations deemed appropriate and necessary by Indico.

21. Blocking and/or Suspension

Indico has the right, at the discretion and convenience of all its customers, to block and/or suspend the Service in the event of matters such as but not limited to: (i) if there is an official request from the competent authority; (ii) if there is an indication of misuse in any way that causes harm to both Indico and other customers; (iii) if the User violates these Terms and Conditions; (iv) if the use of the Service is strongly suspected (accompanied by valid evidence) to commit unlawful acts such as but not limited to fraud, as stipulated in the laws and regulations applicable in Indonesia. For the blocking and suspension of the Service, the User cannot claim any compensation from Indico.

22. Prohibition

While using this Service, the User or other related third parties are prohibited from using this Service in the event of:

  1. Illegal activities Activities that violate the applicable laws, provisions or regulations, including but not limited to laws on confidentiality of communications and wiretapping.
  2. Harmful or deceptive activities Activities that may be harmful to other users of the Service, its operations, or its reputation, including but not limited to offering or distributing goods, Service, programs or promotions that are deceptive or other fraudulent practices.
  3. Content Infringement Contents that violate or abuse the intellectual property rights or proprietary rights of others.
  4. Offensive contents Defamatory, obscene, harassing, privacy invasive, offensive, obscene contents or other objectionable contents.
  5. Harmful contents Contents or other computer technologies that may harm, interfere with, secretly eavesdrop on, or take over any system, program or data, including viruses, Trojan horses, worms, time bombs or cancelbots.
  6. Spam Spam-related activities, including the distribution, publication, transmission or facilitation of the unsolicited mass delivery of e-mails, promotions, advertisements or solicitations, including commercial advertisements and information announcements.
  7. Security Breach Use of this Service to violate the security or integrity of a network, computer or communication system, software application or network or computing device
  8. Commercial or unauthorized use of the Service for income-generating businesses, commercial enterprises or other purposes that are not legal according to these Terms of Use or are not in accordance with the cooperation agreement agreed between Indico and you.
  9. Network misuse Use of the Service to commit network abuse, including attacks on computers or servers within the internet network or intentional involvement with the proper functioning of a network, computer or communication system, software application or network or computing device.

23. Severability

If any provision of these Terms and Conditions is held to be unlawful, void, or for any reason unenforceable under the laws of that jurisdiction, the provision is deemed severable from these terms and conditions and will not affect the validity and enforceability of the remaining provisions in the jurisdiction as well as the validity and enforceability of the provisions under the laws of other jurisdictions.

24. Choice of Law

These Terms of Use will be governed by and construed in accordance with the laws of the Republic of Indonesia, without regard to its conflict of laws principles. You agree that any legal action or dispute that may arise out of, relate to, or be in any way related to the Service and/or these Terms of Use will be resolved within the jurisdiction of the Republic of Indonesia.

25. Force Majeure

Force Majeure is an extraordinary event that occurs beyond Indico’s control which can cause the User to not be able to enjoy the TelkomselDFE Platform, such as but not limited to:

a. Natural disasters such as earthquakes, hurricanes, accidents, floods, wars, riots, or other emergencies determined by the Government;

b. Actions/deeds/conditions of other parties so that Indico cannot provide services to Users;

c. Technical problems/other reasons beyond Indico’s control and authority;

In the event of a force majeure as referred to above, Indico is released from its responsibilities.

26. Miscellaneous

a. Indico, without prior notification to the User, has the authority to take any action deemed necessary for any alleged violation or breach of the Terms & conditions and/or the applicable law. Actions that can be taken include but are not limited to suspending an account, deleting the user’s account and/or in accordance with the applicable laws and regulations.

b. Anything that has not been and/or is not regulated in the terms and conditions specifically for these service features will refer to the TelkomselDFE Platform Terms and Conditions in general.
